Solicitud de aclaración de la Sentencia C-506/23 presentada por el representante legal de la Asociación Colombiana de Industrias Plásticas.
El solicitante puso de presente a la Corporación que la declaratoria de inexequibilidad de la expresión “bienes para su comercialización en el territorio colombiano, que estén contenidos en” buscó corregir la falta de certeza sobre la sujeción pasiva del tributo, pero, eliminó la claridad que existía sobre la territorialidad del impuesto que, por cierto, fue voluntad del legislador incluir expresamente en el literal c del artículo 50 de la Ley 2277 de 2022.
Encontró la Sala que la petición formulada no cumple con la carga argumentativa necesaria para demostrar que la parte resolutiva de la providencia de la referencia contiene conceptos o frases que ofrezcan un verdadero motivo de duda y que lo que realmente propone es abrir un debate que fue finalizado por la Sala Plena en dicho fallo.
Con base en lo anterior se RECHAZA la aclaración pretendida en eta oportunidad.

- PRIMERO. RECHAZAR la solicitud de aclaración de la Sentencia C-506 de 2023, presentada por Daniel Mitchell Restrepo, en su calidad de representante legal de la Asociación Colombiana de Industrias Plásticas -ACOPLASTICOS-, en tanto es improcedente.
- SEGUNDO. Por intermedio de la Secretaría General, COMUNICAR el contenido de esta decisión al solicitante y advertir que contra ella no procede recurso alguno.
